Convict Suing Pharmacist Who Shot Him During Robbery
CHICAGO (STMW) – A convicted robber who was shot while trying to rob a northwest suburban Wauconda pharmacy with a butcher knife last year filed a federal lawsuit Monday against the store asking it to pay for his medical bills.
Guy Conti walked into the pharmacy in the 200 block of South Main Street Valentine’s Day 2011 wearing a ski mask, carrying a butcher knife and demanding the pharmacist give him large quantities of pain killers, Wauconda police said at the time.He's claiming that he was shot after he left the store, which isn't supported by the fact that in Chicago, of all places, the pharmacist was not charged. Something tells me that in an unfriendly place like Chi-town, chasing someone out of your store and shooting them in the back would garner some attention to say the least. In any case, it's patently absurd that this lawsuit might even see the light of day. Now, granted, it has only been filed - and you can file anything you want.
This is the real reason for Stand Your Ground, folks. If this lawsuit is allowed to proceed, that pharmacy is going to be out far more than the cost of the drugs that guy was trying to steal in legal costs alone. Even if they mount a successful legal campaign and are declared blameless, they're still out the defense fees and court time. Stand Your Ground laws incorporate freedom from civil suits when a defensive shooting is legally found lawful - in other words, crooks that aren't shot dead don't get to win the legal lottery ten years after.
Get hurt robbing a store? Tough titties - that's your occupational hazard, goblin. Next time I hope you get your own DGC entry.

And this, my friends, is EXACTLY why big outfits like Walgreens, 7-11, Pizza Hut, etc. have corporate policies against employees defending themselves. My prediction: the lawsuit will proceed, the pharmacy will be forced to settle to avoid extremely expensive litigation, and the tide for our side will begin to recede. This suit shouldn't have even been allowed to be filed. *sigh*
The lesson I'd take away from all this is "Next time, empty your magazine to ensure a kill."
Not unusual at all, Jay. Mas Ayoob wrote about his 30 years ago. Seems that the Thief who gets shot tends to tie up with another Thief (the Shyster) and still tries to rob you. They go after the Homeowners Insurance Policy. And WAAAAY too many Judges allow it to go through. That's part of the reason good "Castle Doctrine" laws usually have some clause where the Civil Suits are much tougher to implement that they used to be.
Yes, this is exactly why Castle Doctrine and stand Your Ground Laws are enacted.
The purpose of the butcher knife is to threaten the life and physical well-being of the robbery victim. It worked as intended. A more effective return in kind should not be punished.
Perhaps the pharmacist needs to become acquainted at the range with the "Mozambique Drill"?

Even if you do kill the assailant, there could be family members who'll bring a suit anyway. But at least you don't have to see the perp sitting across the aisle smirking at you.
Yep, excellent point! And agree with Les, it cost a friend of mine his career (and he was a cop), because he pinned a bad guy with his car, rather than killing him with a gun...

WTF does Trayvon Martin have to do with this? Seems to me this is a pretty clear case of someone wanting to get their dead-hero worship in anywhere, regardless of how stupid they look doing so.
Perp was convicted of threatening to kill someone with the butcher knife they were waving about during the armed robbery they were committing. Perp got shot up for his trouble and the Powers That Be seemed not to care about him not being in the victim's face waving that knife when he got shot. Maybe the "fleeing felon" rule? Maybe just fed up with druggies robbing?
But how does poor, sweet, angelic Trayvon Martin figure into that at all?

@Daniel: Yes, far better to let the thug sitting on your chest beat your head into the pavement until you are dead. That way, you can go to your grave with a clear conscience. The last thing you want to do is to defend yourself from the person trying to kill you.
